ขณะที่ความคืบหน้ากรณี คณะกรรมการกำกับกิจการพลังงาน (กกพ.) มีมติยกเลิกสัญญาซื้อขายไฟฟ้า 90 เมกะวัตต์ ระหว่าง TPIPP กับ การไฟฟ้าฝ่ายผลิตแห่งประเทศไทย (กฟผ.) เนื่องจากโครการโรงไฟฟ้าเชื้อเพลิงขยะไม่ผ่านการจัดทำรายงาน EIA นั้น ที่ผ่านมา TPIPP ได้ยื่นขออุทธรณ์ต่อประธาน กกพ. เพื่อขอขยายระยะเวลาลงนามในสัญญาซื้อขายไฟฟ้าออกไป โดย กกพ.มีมติเมื่อวันที่ 18 ม.ค.60 อนุมัติการขยายระยะเวลาลงนามในสัญญาซื้อขายไฟฟ้าขนาด 90 เมกะวัตต์กับ กฟผ.ไปอีก 290 วัน โดยมีเงื่อนไขการรับซื้อไฟฟ้าเช่นเดิม คือมีส่วนเพิ่มค่าไฟฟ้า (Adder) 3.50 บาท/หน่วย เป็นเวลา 7 ปี
